Salary sacrifice home loan and the minimum wage: a practical check
The adult national minimum wage from 1 July 2026 is $26.44 per hour or $1,004.90 per week, with super of 12% on top.
Salary sacrifice home loan and your minimum wage
If you are considering a salary sacrifice home loan arrangement, it is important to understand how this voluntary agreement interacts with Australia's minimum wage laws. Salary sacrifice allows you to direct part of your pre-tax salary to pay home loan interest, reducing your taxable income. However, this arrangement does not change the legal minimum your employer must pay you for your work. This guide helps you check your hourly rate against the relevant pay floor, whether you are covered by the national minimum wage, a modern award, or an enterprise agreement.
The legal minimum wage
The Fair Work Commission sets the national minimum wage. From the first full pay period on or after 1 July 2026, the adult national minimum wage is $26.44 per hour, or $1,004.90 per week for a 38-hour week. Casual employees receive a 25% loading, giving a minimum casual rate of $33.05 per hour. These rates apply to national-system employees who are not covered by a modern award or enterprise agreement. If you are covered by an award, the award rate may be higher. The Fair Work Ombudsman provides guidance on which award applies and enforces compliance.
Salary sacrifice and the minimum wage
Salary sacrifice for a home loan is a common way to reduce tax, but it does not allow your employer to pay you less than the minimum wage. Your ordinary time earnings (the gross amount before any sacrifice) must still meet or exceed the applicable minimum. The sacrificed portion is still considered wages for super guarantee purposes. Your employer must pay super of 12% on top of your ordinary time earnings, including the sacrificed amount. This means your total remuneration package (salary plus super) is higher than your cash pay, but the minimum wage obligation is based on your ordinary time earnings before sacrifice.
How to compare your rate
To check if your pay meets the legal floor, take your hourly rate before any salary sacrifice. If you are award-free and over 21, the minimum is $26.44 per hour. If you are under 21, junior percentages apply: for example, a 16-year-old award-free junior earns at least $12.51 per hour (47.3% of the adult rate), and a 20-year-old earns $25.84 per hour (97.7%). Casual juniors also receive the 25% loading. If you are covered by an award, check the award's lowest classification rate. The ABS May 2026 survey shows average full-time adult ordinary-time earnings of $2,083.70 per week, well above the minimum. Your negotiated salary may be higher than the award or national minimum, and salary sacrifice can be arranged on that higher amount.
Super guarantee on salary sacrifice
Super guarantee is calculated on your ordinary time earnings, which includes salary sacrifice amounts. For example, if you earn $1,000 per week and sacrifice $200 for your home loan, your employer still pays super on the full $1,000. The 12% super is an employer payment on top of your ordinary time earnings, not deducted from your pay. This is important because salary sacrifice does not reduce your super entitlement.
When a higher rate applies
A modern award or enterprise agreement can set a higher minimum than the national minimum. If you are covered, your employer must pay at least the award rate, even if you salary sacrifice. Always check your award or agreement before entering a salary sacrifice arrangement. For more details, see Which minimum wage applies and Rate tables. Also note that apprentices and trainees have special rates under the Miscellaneous Award if award-free.
Practical check
Take your hourly rate (before sacrifice) and compare it to the relevant floor. If you are award-free and over 21, $26.44 per hour is the minimum. If your rate is lower, your employer may be underpaying you, regardless of any salary sacrifice arrangement. Contact the Fair Work Ombudsman if you have concerns. Remember, salary sacrifice is voluntary and cannot be used to justify paying below the minimum.
For the published floors, see the rate tables and how the figures work.
Questions people ask next
Can I use salary sacrifice for a home loan to reduce my taxable income below the minimum wage?
No. Salary sacrifice reduces your gross salary for tax purposes, but your employer must still pay you at least the minimum wage in ordinary time earnings. The sacrificed amount is still counted as wages for super guarantee purposes.
Does salary sacrifice affect my super guarantee?
Yes, but not negatively. Super guarantee is calculated on your ordinary time earnings, including any salary sacrifice amounts. Your employer must pay 12% super on top of your total ordinary time earnings, even if part of your salary is sacrificed.
How do I check if my salary sacrifice arrangement complies with the minimum wage?
Compare your hourly rate (before salary sacrifice) to the applicable minimum wage. If you are award-free, the national minimum is $26.44 per hour. If you are covered by an award, the award rate may be higher. Salary sacrifice cannot bring your cash pay below the minimum, but your employer must still meet the minimum wage obligation.
