Salary Package Rent and the Minimum Wage: A Guide for Australian Workers
The national minimum wage from 1 July 2026 is $26.44 per hour or $1,004.90 per week for award/agreement-free adult employees, but salary packaging for rent cannot reduce your cash pay below this floor.
What is salary package rent?
Salary package rent is a common arrangement where an employer pays some or all of an employee’s rent as part of their overall remuneration package. This is a form of salary packaging (also called salary sacrifice) that reduces the employee’s taxable income, because the rent is paid from pre-tax dollars. It is often offered in industries such as healthcare, charities, and not-for-profit organisations, where employees may be eligible for fringe benefits tax concessions. However, the arrangement must comply with tax laws set by the Australian Taxation Office and cannot be used to circumvent minimum wage obligations.
How salary package rent interacts with the minimum wage
Under the Fair Work Act, every employee in Australia’s national system is entitled to a minimum wage. The Fair Work Commission sets the national minimum wage, which from 1 July 2026 is $26.44 per hour or $1,004.90 per week for adult employees not covered by an award or registered agreement. The Fair Work Ombudsman explains and enforces these rules. If you are covered by a modern award, the award rate applies instead, and it may be higher than the national minimum. For example, the lowest ongoing classification under most awards is at least $26.44 per hour, but some introductory rates can be as low as $25.74 per hour for the first six months.
Salary packaging for rent does not change the minimum cash wage your employer must pay you. The benefit of having your rent paid is a non-cash component, but your employer must still ensure that the total value of your pay (including any salary-sacrificed amounts) does not fall below the applicable minimum wage. In practice, this means your cash salary after the rent sacrifice cannot be less than the minimum wage. If your employer tries to use the rent payment to reduce your cash pay below the legal floor, that would be a breach of the Fair Work Act.
It is also important to remember that certain employees can be paid less than the adult national minimum wage. Junior employees (under 21) have percentage-based minimum rates, and apprentices and trainees have their own special rates set by the Miscellaneous Award. For award-free juniors, the rates range from $9.73 per hour for under-16s to $25.84 per hour for 20-year-olds. These lower rates apply regardless of any salary packaging arrangement.
Legal minimum vs award rates and super
When comparing your salary package, you need to separate the legal minimum from the award rate and any negotiated salary. The legal minimum is the floor set by the national minimum wage or your award. Your award may specify higher rates for particular classifications, plus penalty rates for overtime, weekends, or public holidays. A negotiated salary can be above the award, but it cannot be below it. Salary packaging for rent is a way to structure your pay, but it does not change the minimum rate you must receive in cash or allowable benefits.
Superannuation is an employer payment on top of your ordinary time earnings. From 1 July 2026, the super guarantee is 12% of your ordinary time earnings. If you salary sacrifice rent, the super guarantee is generally calculated on your reduced cash salary, unless the rent payment is considered ordinary time earnings under ATO rules. This can affect your retirement savings, so it is worth checking with your employer or a tax professional.

If you are negotiating a salary package that includes rent, always confirm that the cash component meets the minimum wage after the sacrifice. The Fair Work Ombudsman provides free advice, and the Fair Work Commission publishes the Modern Awards Pay Database with current rates.

Questions people ask next
Can my employer include rent payments as part of my salary package to meet the minimum wage?
No. Salary packaging for rent is a non-cash benefit that reduces your taxable income, but your employer must still pay you at least the minimum wage in cash or other allowable benefits. The Fair Work Ombudsman states that salary packaging cannot reduce your pay below the minimum wage.
Does salary package rent affect my super guarantee?
Yes. Super guarantee is calculated on your ordinary time earnings, which generally includes the cash salary but not salary-sacrificed amounts that are not ordinary time earnings. However, salary-sacrificed rent may be considered ordinary time earnings for super purposes if it is a benefit provided under an effective salary sacrifice arrangement. Check with the ATO.
How does salary package rent compare with award rates?
Award rates may be higher than the national minimum wage. If you are covered by an award, your employer must pay at least the award rate, regardless of any salary packaging arrangement. Salary packaging cannot reduce your pay below the award minimum.
